Terms and Conditions of the Giveaway.

Organizer: this Survey giveaway the (“Giveaway”) is organized by Qualifyze GmbH, with registered office at Bockenheimer Anlage 46, 60322, Frankfurt am Main, Germany and registry number  HRB 109486. 

Participants: all natural persons users of the Qualifyze platform that have experienced our audit planning processes and aged 18 or older residing worldwide can participate in the Giveaway. Employees of Qualifyze GmbH or any of its affiliated companies are excluded from participation. Any person established in a country or territory with which Qualifyze does not conduct business (Iran, Syria, Sudan, Cuba, Crimea&Sevastopol, North Korea, Russia, and any other territory subject to Trade Sanctions – Trade sanctions are restrictions or prohibitions imposed by relevant authorities on the supply of services to specific territories or parties; they may target countries, entities, or individuals, and typically limit exports, imports, or financial transactions. Sanctions are enforced under regulations such as those from OFAC, the U.S. Export Administration Regulations, the UK Export Control Act 2002, and EU sanctions laws) are excluded from participation. 

Timeline: giveaway launch will be done on July 25th, 2025, 10:00 AM CET. 

Participation Deadline ends on August 15th, 2025, 10:00 AM CET. From that moment onwards, no further submissions will be accepted. 

The winner will be selected on August 18th, 2025, 10:00 AM CET and notified as soon as possible. 

Participation: in order to participate, participants must respond to all questions and submit all answers of the “your audit planning experience matters” survey. Only one submission per person is accepted. Qualifyze GmbH reserves the right to verify that all conditions of participation have been met. This includes, but is not limited to confirming that participants: (i) meet the eligibility criteria and have correctly responded to all the questions. Additionally, Qualifyze GmbH also reserves the right to disqualify entries that appear to involve automated or fraudulent means, including but not limited to: (i) use of bots or scripts; (ii) creation of fake accounts; (iii) mass participation attempts from the same IP address or device. Any manipulating or attempting to tamper with the entry process will lead to immediate exclusion from the Givawa. Legal action may be taken in case of fraudulent behaviour. 

Winner selection: the winner will receive a 100 EUR Amazon card. The prize is non-transferable and cannot be exchanged for cash. The organizer reserves the right to substitute the prize with a similar item of equivalent value if necessary. The winner will be selected randomly using Microsoft Excel, by assigning each valid entry a number and using a randomization function to choose the winner. The process ensures fairness and impartiality. There will be one winner of the Amazon card. Qualifyze GmbH will contact the winner on the week of August 18th by email. The winner has 10 (ten) working days to confirm the acceptance of the prize. If a winner cannot be contacted or does not respond within the stated time, a new winner will be drawn. Any taxes, duties, or other charges that may be incurred in connection with the receipt or use of the price are solely the winner’s responsibility. Qualifyze GmbH is not liable for any tax obligations that may arise.

Miscellaneous: The organizer reserves the right to cancel, suspend, or modify the giveaway at any time if deemed necessary. This may be due to external factors beyond the organizer’s control (force majeure), legal reasons, technical problems, or other operational concerns. The organizer also reserves the right to terminate the giveaway early or withdraw it at its sole discretion, even without giving specific reasons, provided this does not disproportionately disadvantage participants and is done in good faith. In any case of cancellation, participants shall have no legal claim to continuation or to the prize.

Law and jurisdiction: this Giveaway is subject to German substantive law and the exclusive place of jurisdiction is Frankfurt, Germany. 

Privacy Policy: the data Controller is Qualifyze GmbH (details above); the data collected from the participants are: name, surname and email address. The data is processed solely for the management of the participation, selection and contacting the winner and sending the price. The legal basis is art. 6(1)(b) GDPR (performance of a contract). The data will be retained in accordance with Website and app privacy policy. Qualifyze GmbH will not share data with third parties unless required for prize delivery. Participants have the right to: access their data, rectify or erase the data, restrict the processing, object to the processing or file a complaint with the supervisory authority. The supervisory authority responsible for Qualifyze is the Hessian Commissioner for Data Protection and Freedom of Information.A list of all German supervisory authorities and their contact details can be found here.
